Thank you for visiting ALYKA Health Technologies (“ALYKA”, “we” and “us”). We own and operate a web-based platform (https://alykahealth.com/)(“Platform”) mobile applications (“App”) (collectively, “Services”). As a Health Technology company, we make Privacy and protecting health data a priority. We believe in transparency and want you to know how we use data collected about you. Your access and use of the Platform, any part thereof, or anything associated therewith, the App, any products or Services provided by ALYKA are subject to this Privacy Policy unless specifically stated otherwise. By visiting or using our Platform, App or Services, you agree to this Privacy Policy and the Terms of Use located at https://alykahealth.com/privacy-policy/which are incorporated into this Policy by reference.

By accessing or using the Services, you are automatically accepting and acknowledging the most recent version of this Privacy Policy. If we make any changes to our Privacy Policy, we will post the revised Privacy Policy and update the “Last updated” date of the Privacy Policy.

If you are using the Services on behalf of an individual other than yourself or an entity, you represent that you are authorized by such individual or entity to act on such individual’s or entity’s behalf and that such individual or entity acknowledges the practices and policies outlined in this Privacy Policy.

By using the Services, you represent that you are at least 18 years old and of legal age to enter into legal agreements.

Personal Data We Collect or Process

When you set up an account with ALYKA, you are creating a direct customer relationship with ALYKA that enables you to access and/or utilize the various functions of the Platform, App and Services as a user. As part of that relationship, you provide information to ALYKA, including but not limited to, your name, email address, physical address, phone number and certain transactional information, that we do not consider to be “protected health information” or “medical information”.

However, in using certain components of the Services, you may also provide certain health or medical information that may be protected under applicable laws. ALYKA is not a “covered entity” under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its related regulations and amendments from time to time (collectively, ” HIPAA”). It is important to note that HIPAA does not necessarily apply to an entity or person simply because there is health information involved, and HIPAA may not apply to your transactions or communications with ALYKA.

In addition, any medical or health information that you provide that is subject to specific protections under applicable state laws (collectively, with PHI, “Protected Information”), will be used and disclosed only in accordance with such applicable laws. However, any information that does not constitute Protected Information under applicable laws may be used or disclosed in any manner permitted under this Privacy Policy. Protected Information does not include information that has been de-identified in accordance with applicable laws.

By accessing or using any part of the Services, you are agreeing that even if HIPAA does apply to ALYKA, any information that you submit to the Services is not considered Protected Information and will only be subject to our Privacy Policy and any applicable laws that govern the privacy and security of such information.
Your employer may provide, or authorize the provision by third parties of, certain information to ALYKA Health in order to implement the Services and onboard individual employee users.

We also collect information that you provide to us voluntarily or that you authorize third parties to provide to us to enable use of Services and provide a personalized experience. ALYKA Health collects the information that you provide to us when you sign up for Services, subscribe to our newsletters, acknowledge advisories, accept announcements and invitations and contact us by email or through the Services via a “contact us” feature. We use this information only to provide our services to you and respond to your comments, requests or questions. Providing this information is completely voluntary.

In connection with provision of the Services through our applications or website, we request, and ask for your consent to use, the following information:

  • Contact Data including name, address, email address, and telephone numbers.
  • Information about your identity that is necessary for us to match an individual user’s data with their health records, including date of birth.
  • If you subscribe for Services personally, we request payment card information.
  • Your preferences with respect to receiving marketing communications from us and our third parties.

From time to time our interactions with you will be conducted over the telephone or video-conference, and such telephone calls and video conferences may be recorded.

COOKIES

The Services may capture some information about you automatically utilizing background local storage and session storage technologies (“Cookies”). Cookies are small files or other pieces of data which are downloaded or stored on your computer or other device, that can be tied to information about your use of the Services (including certain third-party services and features offered as part of our website). Examples of information of this type are your IP address, UDID or other unique identifier, device functionality (web browser, OS, hardware model, mobile network), subscription level, any URL that referred the user to our site, each area that the user accesses within the site or mobile application and the activities the user performs in that area (remembering the user, preferences, pages requested/viewed), device location, device characteristics, time of day. When we use Cookies, we may use “session” Cookies that last until you close your browser or “persistent” cookies that last until you or your browser delete them. We may also use other tracking technologies such as web beacons, embedded scripts and entity tags. Some Cookies are “strictly necessary” for system administration, fraud prevention, and improvement of our Services. We will also use Cookies or other tracking technologies to assess the performance of the Services, as part of our analytics practices, and to improve the content, products, and Services we offer through the mobile application, website, and Services. You may change your browser setting to decline the use of some types of Cookies.

How We Use the Data

We use the personal data we collect to respond to your inquiries, provide or enhance the Services you request, perform our contractual obligations, provide updates and other important information related to your activity on and with the Services, improve the Services, inform you of new Services or changes in Services, administer the Services, enter into contracts for services, fulfill legal obligations we have to governmental authorities or other third parties, and for other legitimate business purposes. You will have the opportunity through your user settings to opt out of any electronic marketing communications you may receive from us.

ALYKA uses aggregated and de-identified data for purposes of internal application research and development, population level research, clinical quality improvement, with publication and presentation of such findings in professional conferences and journals.

With Whom We Share Personal Data

ALYKA Health is a provider of services headquartered in the United States, and as such may need to share information with internal personnel and our affiliates located in different geographic locations in order to perform our Services. We may also share your data with third parties (within or outside your country of residence) who perform services on our behalf, including without limitation our technology providers, electronic health record vendors, payment card processors and professional advisors. We do not sell or share your personal data with any third-party for such third-party’s marketing or promotion services.

We may disclose information (within or outside your country of residence) if we have a good faith belief that disclosure is necessary by law or the legal process, to protect and defend our or others’ interests or property, or to enforce agreements you enter into with us.

Your information may be transferred to another company (within or outside your country of residence) in connection with a merger or in the event that our business is acquired in whole or part by another company.

We may share aggregated and de-identified information with: employers for purposes of analytics, services, improving employee wellbeing programs, employer reports, dashboards and portals; and internally or with third parties (within or outside your country of residence) for analytical, research or other similar purposes.

Alyka Health may obtain your written consent from time to time in electronic form by using online agreements or other acknowledgements on the Services, including for any other contemplated uses of your personal data not addressed in this Privacy Policy. Please read all online agreements carefully before accepting them.

Storage and Protection of Your Personal Data

We retain the personal data we collect for so long as reasonably necessary to fulfill the purposes for which the data was collected and to perform our contractual and legal obligations. Notwithstanding the generality of the foregoing, we store email addresses until the user requests to be unsubscribed or removes themselves through any self-service tools offered to the user.

In addition, de-identified data will be retained for purposes of internal application research and development, population level research, clinical quality improvement, with publication and presentation of such findings in professional conferences and journals.

We take reasonable administrative, physical and technical precautions to protect your personal data and communications between us. This includes, when required or as we deem appropriate and feasible under the circumstances, encryption and written commitments from third parties that may have access to your data to protect and secure the data.

However, no Internet or e-mail transmission is ever fully secure or error free. We therefore cannot guarantee absolute security of your data, and we are not responsible for processes and networks that we do not control. Users assume the risk of security breaches and the consequences resulting from them. Please be careful in deciding what information you send to us via email or over the Internet.

Your Rights, Choices and Disclosures

We are committed to facilitating the exercise of your rights granted by the laws of your jurisdiction, which may include the right to request the correction, and modification or deletion of your personal information and the right to opt out of the sale of your personal information (if applicable). We will do our best to honor your requests subject to any legal and contractual obligations. If you would like to make a request, cancel your account or request we delete or no longer use your account information to provide you Services, contact us at customerservice@alykahealth.com and/or make changes to any user profile information connected to your account.

You may opt out of receiving electronic marketing communications from us by clicking on the “unsubscribe” link on the communication or contacting us at customerservice@alykahealth.com. Some non-marketing communications may not be subject to a general opt-out, such as communications about transactions, disclosures to comply with legal requirements, software updates and other support-related information. If you do not wish to receive any service-related emails from us, you have the option to deactivate your account.

You may be able to disable Cookies through your browser settings, but if you delete or disable Cookies, you may experience interruptions or limited functionality in certain areas of the Services.

California “Shine the Light” Information-Sharing Disclosure: California residents may request a list of all third parties with respect to which we have disclosed any information about you for direct marketing purposes and the categories of information disclosed. If you are a California resident and want such a list, please send us a written request by email to customerservice@alykahealth.com with “California Shine The Light Rights” in the subject line.

California Do Not Track Disclosure: At this time, there is no worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating Do Not Track signals. Thus, our Services are unable to respond to Do Not Track Signals.
California Consumer Privacy Act. ALYKA is not a “business” subject to the California Consumer Privacy Act.

Users Outside the United States

The Services are controlled and operated from the United States. If you are an individual from the European Union, Canada or any other jurisdiction with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that we may store the information we collect in the United States which is not deemed an “adequate jurisdiction” by the European regulatory authorities. Personal data may also be transferred from the country of your residence to other countries, including the United States.

These websites may be operated by companies unaffiliated with ALYKA Health, and we are not responsible for the content or privacy practices of those websites. Privacy Policy Changes

We may update this Privacy Policy from time to time and without prior notice to you to reflect changes in our information practices. Any such amendments shall apply to information already collected and to be collected. Your continued use of the Services after any changes to our Privacy Policy indicates your agreement with the terms of the revised Privacy Policy. Please review this Privacy Policy periodically and especially before you provide personal data to us. If we make material changes to this Privacy Policy, we will notify you here, by email or by means of a notice on our home page.
